General Terms and Conditions of Sale
applicable at PPUH Export-Import Jarosław Lesiak

Orders are fulfilled if they are submitted in writing or by phone, which is tantamount to accepting the General Terms and Conditions of Sale. If you do not accept the GTCS, please inform PPUH Export-Import Jarosław Lesiak within 24 h from order submission. If we are not informed otherwise, the order is deemed submitted for processing without reservations.

Ordered materials can only be collected in person if such collection has been previously agreed and if a valid authorisation from the recipient has been received (by fax or e-mail). The authorisation needs to include such information as the driver’s details: first and last name, ID card number, as well as the registration number of the tractor and trailer.

The Seller may refuse to fulfil an order if the recipient’s receivables insurance becomes invalid or if the recipient exceeds the credit limit granted.

If the Seller is unable to perform the agreement in full or in part for reasons beyond its control attributable to the product manufacturer, the Seller shall have the right to withdraw from the agreement in full or in part. The Seller shall not be liable for any damage incurred.

We reserve the right to transfer the right to receivables arising from the fulfilment of the order.

In case of a delay in payment for a completed delivery, the Seller shall have the right to charge statutory interest, unless the parties agree otherwise.

Products delivered are compliant with the basic requirements set out in technical specifications or requirements should be described in detail in the order.

Deliveries are settled on the basis of the actual weight or the theoretical weight, unless the parties agree otherwise. There is an acceptable quantitative tolerance of +/- 10% for each item and for the entire order.

The Seller informs that in case of steel products sold according to the theoretical weight, the weight is calculated on the basis of the product volume and the following theoretical weight value is adopted: – 8.0 kg/dm3 for all sheet metal made of carbon steel, stainless steel, quality steel and heat-resistant steel. In case of steel products whose weight is determined on the basis of their length, weight values indicated in the conversion tables are adopted, i.e. per mass of 1 running meter [kg/m] – the conversion tables are published on www.lesiak.pl.

Products may be covered with surface corrosion which does not affect the quality of properties of the product.

The buyer should submit any complaints in writing directly after completion of the delivery and finding irregularities with regard to:
– missing quantities,
– inconsistent grade and dimensions of the product,
– visible surface defects (in case of internal defects – within 3 months from delivery).

The risk of loss or damage to goods is transferred from the Seller onto the buyer at the time of the goods being released to the Buyer.

Documents such as quality certificates and approvals are always supplied as copies of the original documents via e-mail or fax.
